Digital Product Agreement & Terms of Purchase

This agreement governs the purchase, download, access, and use of digital products — kits, templates, prompts, guides, and related materials (the "Product") — sold by theCommons Academy, a trade name of theCommons OS LLC (the "Company"), to you (the "Buyer"). By checking the consent box at checkout or submitting payment, you agree to these terms in full.

1. License — what you may and may not do

On payment, the Company grants you one single-user, non-transferable, non-exclusive, revocable license to use the Product for your personal use or your own internal business operations. You may not: copy or redistribute the Product; share, resell, or republish it in whole or in part; share access credentials or download links; host it on shared drives or team networks; or resell it, or derivatives of it, as your own product (including as PLR or "master resell rights" material). Doing any of these is a material breach of this agreement and ends your license immediately. The Company keeps sole ownership of all intellectual property in the Product, including the underlying source files. Buying the Product buys you the license above — not the copyright. (Want your team to use a kit? That's a different license and it's cheap and easy — contact us and we'll set it up properly.)

2. Refund policy

Because the Product is digital and delivered instantly in full, all sales are final; no refunds, exchanges, or cancellations. Checkout completes the transaction. You agree not to initiate chargebacks or payment disputes for a delivered Product; any unauthorized chargeback ends your license, permanently revokes access, and the Company may pursue recovery of the disputed amount and reasonable administrative costs.

3. No warranties; limited liability

The Product is provided "as is", without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. The Company does not warrant that the Product is free of errors or omissions. To the maximum extent permitted by law, the Company is not liable for indirect, consequential, special, or punitive damages — including lost profits, lost data, or business interruption — arising from the Product. If the Company is found liable despite this section, total liability is capped at the price you paid for the Product.

4. Outcomes disclaimer

The Product is educational and informational. The Company makes no guarantee of any specific result — financial, professional, or otherwise. Results depend on factors outside the Company's control, including your execution, your market, and your effort. Time-savings figures in the Product are illustrative estimates, not promises. You are responsible for your own outcomes and for complying with the laws, professional rules, and confidentiality obligations that apply to your own work — including how you use AI tools with client information. You agree to hold the Company, its officers, and its contractors harmless from claims arising out of your application of the Product.

5. Governing law; severability

This agreement is governed by the laws of the State of Maryland, where theCommons OS LLC is registered, without regard to conflict-of-law rules. If any provision is found unenforceable, the rest remains in full effect. Last updated: July 2026.
