Terms of Service

By accessing or using theCommons Academy website, Living Library, newsletters, or any related tools (collectively, the “Services”), you agree to these terms. If you do not agree, please do not use the Services. We may update these terms from time to time; continued use of the Services after an update means you accept the revised version.

You may not use the Services in any way that violates applicable laws, infringes on the rights of others, disrupts the experience of other members, or attempts to access accounts, systems, or data you are not authorized to reach.

Use of Services

You agree to use the Services responsibly and only for their intended purpose — learning, member collaboration, and working through the frameworks and tools we publish. You are responsible for keeping your account credentials secure and for the activity that happens under your account.

We reserve the right to suspend or terminate access for behavior that harms other members, misuses the Services, or violates these terms. We may also change, pause, or discontinue individual features as the product evolves.

Intellectual Property

All materials, frameworks, essays, tools, assessments, illustrations, and other content published by theCommons Academy are owned by theCommons Academy or licensed to us, unless otherwise stated. This includes the FuBO name and the 7 FuBO Cognitive Archetypes.

You may reference and share our public content with attribution and a link back to the original page. You may not resell, relicense, or reproduce our paid content, member materials, or downloadable tools without written permission. Any feedback or suggestions you send us may be used to improve the Services without obligation to you.

Privacy Policy

We collect the information you give us directly — such as your name, email address, and any details you submit through our forms or the free tools — along with basic usage data (for example, the pages you visit, the device and browser you use, and referring links) that helps us understand how the Services are being used.

We do not sell your personal data. We share information with the third-party tools listed below only to the extent required to operate the Services.

How We Use Data

We use the information we collect to deliver the Services, respond to your messages, send transactional emails (such as receipts and account notices), share the newsletter and program updates you opted into, and improve the quality of our content and tools over time.

You can unsubscribe from marketing emails at any time using the link at the bottom of any newsletter, or by contacting us at the address below. Transactional messages tied to an active account may continue.

We keep your contact and assessment data while you're actively engaged with us and for up to 24 months after your last activity, then delete or anonymize it, unless the law requires us to keep it longer.

Children

Our Services are intended for adults and are not directed to children under 16; we do not knowingly collect their data.

Third-Party Tools

We rely on a small set of trusted platforms to operate the Services, including HubSpot for email and CRM, Stripe for payment processing, and standard analytics and hosting providers. These vendors process information on our behalf under their own terms and privacy policies.

Where a page embeds a third-party tool (for example, an assessment, scheduling widget, or video), that provider may collect its own usage data governed by its own privacy notice.

Our processors (HubSpot, Stripe, and our database provider) are based in the United States; where we transfer data from the EU or UK, we rely on Standard Contractual Clauses.

Cookies & Tracking

We use cookies and similar technologies to keep you signed in, remember your preferences, measure how visitors move through the site, and improve performance. Some cookies are strictly necessary for the site to work; others help us understand aggregate usage.

We design our systems with human oversight and responsible data practices, but AI outputs can be incomplete or inaccurate — always review before acting on them.

Your archetype and friction results are AI-assisted insights meant to guide you — they are not automated decisions made about you, and we never sell them.

Payments & Refunds

Certain Services require payment. Prices, currencies, and included benefits are shown on the relevant page at checkout. Unless otherwise stated in writing, all purchases are non-refundable. Pricing, bundles, and program formats may change at any time; changes do not affect purchases already completed.

Your Rights

You may request access to, correction of, or deletion of the personal data we hold about you by contacting the address below. We will respond within a reasonable timeframe and may need to verify your identity before making changes.
