Terms of Service

By accessing or using theCommons Academy website, Living Library, newsletters, or any related tools (collectively, the “Services”), you agree to these terms. If you do not agree, please do not use the Services. We may update these terms from time to time; continued use of the Services after an update means you accept the revised version.

You may not use the Services in any way that violates applicable laws, infringes on the rights of others, disrupts the experience of other members, or attempts to access accounts, systems, or data you are not authorized to reach.

Use of Services

You agree to use the Services responsibly and only for their intended purpose — learning, member collaboration, and working through the frameworks and tools we publish. You are responsible for keeping your account credentials secure and for the activity that happens under your account.

We reserve the right to suspend or terminate access for behavior that harms other members, misuses the Services, or violates these terms. We may also change, pause, or discontinue individual features as the product evolves.

Living Library notice

Access to the Toolkit is provided as a dynamic, living library. theCommons Academy reserves the right to decommission, vault, or cap access to specific tools at any time. New tools and tracks are added monthly and older ones may be retired, revised, or moved behind a different tier as the curriculum evolves.

The tools provide back-of-the-envelope estimates grounded in reality, not guarantees. They are for illustrative, educational, and planning purposes only and do not constitute financial, legal, or compliance advice.

Intellectual Property

All materials, frameworks, essays, tools, assessments, illustrations, and other content published by theCommons Academy are owned by theCommons Academy or licensed to us, unless otherwise stated. This includes the FuBO name and the 7 FuBO Cognitive Archetypes.

You may reference and share our public content with attribution and a link back to the original page. You may not resell, relicense, or reproduce our paid content, member materials, or downloadable tools without written permission. Any feedback or suggestions you send us may be used to improve the Services without obligation to you.

Privacy Policy

We collect the information you give us directly — such as your name, email address, and any details you submit through our forms or the free tools — along with basic usage data (for example, the pages you visit, the device and browser you use, and referring links) that helps us understand how the Services are being used.

We do not sell your personal data. We share information with the third-party tools listed below only to the extent required to operate the Services.

Who is responsible for your data

theCommons Academy is the data controller for the personal data described on this page. You can reach us about anything privacy related at info@thecommonsacademy.com. If you would like our postal address for a formal notice, ask and we will provide it in writing.

Why we’re allowed to use it (legal bases)

Under the GDPR every use of personal data needs a lawful basis. Ours are:

• Contract — creating and running your account, giving you the Library, Vault, and tools you paid for, and sending transactional email such as receipts and account notices.
• Consent — marketing email and the newsletter, and any analytics or marketing cookies. You can withdraw either at any time.
• Legitimate interests — keeping the Services secure, preventing abuse, and understanding in aggregate which content is useful, balanced against your interests and rights.
• Legal obligation — keeping transaction and tax records for as long as the law requires.

How We Use Data

We use the information we collect to deliver the Services, respond to your messages, send transactional emails (such as receipts and account notices), share the newsletter and program updates you opted into, and improve the quality of our content and tools over time.

You can unsubscribe from marketing emails at any time using the link at the bottom of any newsletter, or by contacting us at the address below. Transactional messages tied to an active account may continue.

We keep your contact and assessment data while you're actively engaged with us and for up to 24 months after your last activity, then delete or anonymize it, unless the law requires us to keep it longer.

Children

Our Services are intended for adults and are not directed to children under 16; we do not knowingly collect their data.

Third-Party Tools

We rely on a small set of trusted platforms to operate the Services, including HubSpot for email and CRM, Stripe for payment processing, and standard analytics and hosting providers. These vendors process information on our behalf under their own terms and privacy policies.

Where a page embeds a third-party tool (for example, an assessment, scheduling widget, or video), that provider may collect its own usage data governed by its own privacy notice.

Our processors (HubSpot, Stripe, and our database provider) are based in the United States; where we transfer data from the EU or UK, we rely on Standard Contractual Clauses.

Cookies & Tracking

Two categories, and only one of them is a choice:

We ask before we load anything in the second row. Until you accept, the HubSpot tracking script is never injected, sets no cookies, and no page-tracking context is attached to anything you submit. “Reject non-essential” is a single click, and if you reject after previously accepting we delete the HubSpot tracking cookies already on your device. We remember your choice for six months and then ask again. You can change your mind at any time — use the “Cookie settings” link in the footer, or the button below.

Pages that embed a third-party player or scheduler (for example YouTube or Luma) may set their own cookies when you interact with them, under their own notices. You can also control cookies through your browser settings.

AI Use & Disclaimer

Some of our tools and Services use artificial intelligence to support analysis, recommendations, and content generation. These outputs are intended for informational and educational purposes only and should not replace professional or human judgment. We design our systems with human oversight and responsible data practices, but AI outputs can be incomplete or inaccurate — always review before acting on them.

Your archetype and friction results are AI-assisted insights meant to guide you — they are not automated decisions made about you, and we never sell them.

Payments & Refunds

Certain Services require payment. Prices, currencies, and included benefits are shown on the relevant page at checkout. Unless otherwise stated in writing, all purchases are non-refundable. Pricing, bundles, and program formats may change at any time; changes do not affect purchases already completed.

Your Rights

Wherever you live, and specifically if you are in the EU, EEA, or UK, you have the right to:

• Access — get a copy of the personal data we hold about you.
• Rectification — have inaccurate or incomplete data corrected.
• Erasure — have your data deleted, except where we must keep it by law.
• Portability — receive the data you gave us in a machine-readable format.
• Restriction — ask us to pause a particular use of your data.
• Objection — object to processing we carry out on the basis of legitimate interests, including direct marketing.
• Withdraw consent — at any time, without affecting anything we did before you withdrew it.
• Complain — lodge a complaint with your national data protection supervisory authority.
